Eight years ago my parent’s friend Raffi was trying to sell his NYC restaurant. Raffi was a broker and had a license,he puts the restaurant on the market then he met broker Amir and offered to help him sell the restaurant. Amir never showed the restaurant to anyone and 6 months later he left to Israel and disappeared for a while. Then Raffi found a buyer and sold the restaurant.  Amir comes back and wants commission. Amir never sold the restaurant and had no involvement in the sale. This was in 2012. He went to court and filed a civil lawsuit, and intentionally served the court documents to the restaurant that was located in Manhattan, while he had known that they resided in Long Island, therefore they never received the court date and they had no knowledge of lawsuit filed against them.Raffi found out about it only when they sent him subpoena.

Now Raffi’s lawyer is negotiating with Amir’s lawyer. He offered 1k, if he does not agree they will go to the court, Raffi’s lawyer also reminded them that in 2 years the case is going away, therefore if this continues another 2 years Amir will get nothing. The negotiation is still in process and Raffi’s lawyer is still waiting for Amir’s lawyer response.
