REQUEST FOR USER
DATA
Blessing Esomchukwu
BCIS 4730

INTRODUCTION
❖ The issue of request for user data contradict freedom of
expression, which is a fundamental human right.
❖ Freedom of the expression supports the right of individuals to
express themselves without the fear of any repercussion or safety
(Newley, 2020).
❖ Formal human rights should also be handled with diligence and
further consultation with experts of human rights (Newley, 2020).
S O C I A L M E D I A P L AT F O R M S
AND FREEDOM OF
EXPRESSION
❖ Tech companies usually receive requests from government entities to provide user
data for preventing occurrence of death or serious injury.
❖ Social Media platforms like Facebook are also expected to follow local laws in the
countries in which they operate even if freedom of expression applies to users(Newley,
2020).
❖ The volume of request for the data of users vary from one country to another. For
instance, the number of requests have been high in the US than when compared to
China.
❖ WhatsApp as a social media platform believes on the right of individuals to have
private conversation online (Newley, 2020).
DELICATE BALANCING ACT
AND TECH COMPANIES
❖ The balancing act risks the alienation of users because if they refuse,
they might face punishment and criminal actions (Newley, 2020).
❖ The balancing act on the use of social media platform supports what
people perceived to be a chess game (Newley, 2020).
❖ The delicate balancing act on the social platforms was introduced by
China to crush the protests, which had recently ripped Hong Kong City
(Newley, 2020).
SOCIAL MEDIA
CENSORSHIP
❖ The scope of the legislation on social media censorship has given the
police a broad mandate on enforcing it.
❖ The legislation scope also spread an alarm beyond teachers, journalists,
and activists who are already under scrutiny by the authority (Natasha &
Joyu, 2020).
❖ The law on social media censorship targets subversion, secession,
terrorism, and collusion with external forces with the objective of
endangering national security(Natasha & Joyu, 2020).
SIGNIFICANCE OF SOCIAL
MEDIA CENSORSHIP
❖ Censorship of the social medial platforms reduces criminal acts such
as terrorism and kidnapping (Natasha & Joyu, 2020).
❖ However, the scope of the law exceeds wildest of expectations when it
had effect on the freedom of expression (Natasha & Joyu, 2020).
❖ Some section of the law recognizes that business and freedom of
speech are core values of the Hong Kong City (Natasha & Joyu, 2020).
CONCLUSION
❖ In conclusion, the voice of protests might be difficult to be
silenced through censorship.
❖ Even with the implementation of laws of restricting the use of
social media platforms, there are always ways that can be used to
overcome restrictions.
❖ New ways of expression can also be established to avoid going
against security laws.

ANTHONY WONG
Hong Kong’s New Security Law
• China is ensuring that the city has a legal framework to deal
with serious challenges to its authority
• The law gives Beijing powers to change the life in Hong Kong
•Experts say the law will effectively reduce protests and freedom
of speech
•Imposing China’s criminal system onto the Hong Kong common
law system
Some of the new law’s key
provisions
•Beijing will establish a new security office in Hong Kong
•This new office can send some cases to be tried in
mainland China
•Hong Kong will have to create its own national security
commission to enforce the laws, with a Beijing appointed
advisor
•Beijing will have the authority over how the law should be
interpreted
•People suspected of crimes can be wire-tapped and put
under surveillance
•The law applies to non-permanent residents as well
Why did China
pass this law?
China passed this law because of the
protests over an extradition law
became violent and turned into an
Anti-China and Pro-Democracy
movement.
How does this new law affect
citizens?
•Using user data to track and arrest those
suspected of breaking the law
•Take down internet posts and punish
companies that do not comply
•Threatening to jail employees at internet
companies if firms do not comply with
requests for user data
How do these Tech Giants
respond?
•Companies like Google, Facebook, WhatsApp, and
Twitter announced that they would temporarily stop
processing requests for user data and consult with
human rights experts
•TikTok withdrew its app from stores in Hong Kong
and make the app inoperable to users
What are the downside for these
Tech Giants?
•If companies fail to comply, it could lead to jailtime
for employees
•Companies could be fined and be susceptible to
search and seizures
•Their service may be terminated in Hong Kong and
lose access to the Hong Kong Market
Outcomes of the new law
• Used requests for user data to arrest people who have called for
Hong Kong Independence
• If a company fails to comply with a court order to turn over data,
it could be fined to almost $13,000 or an employee could face 6months in prison
• A person can be sent to jail for a year, if they refuse an order to
remove a post
• Residents of Hong Kong have started seeking safer ways to
communicate, like using the encrypted messaging app Signal
• Those fearing prosecution have deleted online posts, likes, and
whole accounts
Conclusion
•The new law uses user data to track and arrest
citizens
•Tech Giants have decided to temporarily stop
requests of user data because of possible violations
of human rights

How secure is
TikTok?
• TikTok has had security
problems
• In December,
researchers at the
security firm Check Point
discovered a number of
bugs in TikTok that could
allow hackers to upload

user accounts and gain
access to personal
information such as
email addresses
Why is the U.S. concerned? Are
U.S. concerns about TikTok new?
➢ The possibility of Beijing performing
mass data collection on American
citizens
➢ U.S. officials are concerned that the
Chinese government is potentially
building a vast database of
information that could be used for
espionage—identifying U.S.
government employees who might
be susceptible to blackmail

Huawei Banned from UK
5G Networks
Report Prepared for: Dr. Koh
University of North Texas
Report Prepared by: Matthew Spradling
Huawei Banned?
• According to The Wall Street Journal the U.K. “…bar telecom
companies from purchasing new equipment made by… Huawei…”
and all Huawei technology is to be removed from 5G Networks by
2027. (2020 Fidler & Colchester)
• This ban only applies to 5G Networking equipment.
• Additional bans on equipment such as fiber-optic networking
equipment is expected.
• The ban comes after a new review by the U.K.’s National Cyber
Security Centre on Huawei.
Brief History of Huawei
• Huawei was founded in 1987 by Ren Zhengfei, a former People’s
Liberation Army technician.
• Huawei started in Shenzhen as a rural sales agent for Hong Kong
based phone and cable network businesses.
• From 1996 to 1998, Huawei expanded into metropolitan areas of
China as the urban population exploded.
• Throughout the 2000s Huawei expanded to have its products in
over 170 countries and serve more than one third of the global
population.
(2018 Roll, 2020 Forbes)
Why is Huawei Under Fire?
• Huawei is accused of being a surrogate to the Chinese Ministry of
State Security and the People’s Liberation Army.
• Huawei affiliated companies are currently being tried for
corporate espionage.
• Huawei is one of the current three predominate 5G network
equipment providers.
• Huawei claims attacks on their credibility are an attempt to hurt
the Chinese economy.
Huawei: Government Spy Agency?
• “A Wall Street Journal review of Huawei’s… financial assistance
details… (shows) Huawei had access to as much as $75 billion in
state support as it grew… to the world’s largest telecomequipment company.” (2019 Yap)
• “Joy Tan, Huawei’s chief global communicator, told me that ‘the
assumption that the Chinese government can potentially interfere
in Huawei’s business operation is completely not true…’ The CIA
has now apparently refuted this.” (2019 Doffman)
Important Note
• Currently only three companies manufacture 5G equipment:
Huawei (China), Ericsson (Sweden), and Nokia (Finland).
• US Companies likely to enter 5G equipment market include Dell,
Microsoft, and AT&T.
• Banning of Huawei from the UK 5G networks does not help
companies and is expected to cost of as much 2 billion pounds.
Conclusion
• The Huawei 5G ban is a national security move.
• The exact details of how Huawei’s equipment could be
used for spying has not been disclosed.
• Multiple national security agencies from numerous
countries are concerned about it.
• National security concerns combined with past corporate
espionage accusations makes the ban seem justified.
“It is expected that Huawei’s growth my slow,
but only slightly.”
-Ren Zhengfei (2019)
