PLEASE POINT OUT THAT RULE IN EACH CASE BRIEF. -The court can come down with several decisions. You are only to brief the majority opinion. We do NOT care about the dissent The court can affirm the lower court’s decision; in that case whatever the lower court decided usually that the defendant was guilty that verdict stands. The court could reverse the lower court and remand (send back) the case for a new trial, in other words, send it back to the lower court to be retried. Finally, the court can reverse the lower court decision for the reasons that you will see in each case and find the defendant not guilty. We have them all in the cases that we study.
