Year policy was created
HIPPA was signed as a law on August 21,1996, signed by
president Bill Clinton. HIPAA was created for many reasons one
was improve the portability and accountability of health
insurance coverage (HIPAA Journal) Other reasons were to
protect patients and healthcare facilities from fraud and abuse of
patients records and insurances. HIPAA allows patients to be in
control of their personal medical records.
Identify the various stakeholders
involved in the creation of this
policy.
HIPAA policy is created by many stakeholders such as
Government- any board of medical, dental etc, health care
administrators, physicians, nurses social workers, all insurance
companies, charities, hospitals and other care providers. This is a
short list of the common stakeholders that are involved with this
policy. Each stakeholder please an important part of decision
making to ensure the policy is being covered from all angles for
the protection of facilities, providers and patients.
Select a level of government
(federal, state, or local) and discuss
the role and function it had in the
process of implementing the policy.
HIPAA was instituted at the federal level of government. A
product of the U.S. Department of Health & Human Services,
this was the agency that established this mandate. These rules
consist of a privacy rule and a security rule, both are standards
used to base all other privacy and security rules concerning
protected health information. State and local rules can be stricter,
but they must not fall below these rules set by HIPAA.
Why was the policy created?
This policy was created to address the issue of keeping a
patients personal health information private. With the use of
technology and the sharing of information electronically, there
must be safeguards in place to protect patients, health care
facilities and professionals associated with a facility or practice.
Prior to HIPAA, no generally accepted set of security standards
or general requirements for protecting health information existed

in the health care industry. At the same time, new technologies
were evolving, and the health care industry began to move away
from paper processes. (U.S.Department of Health & Human
Services, 2019)
Why is the policy important to
health care?
This policy is important to health care because it established a
set of standards that regulated how PHI was to be handled,
throughout the health care industry. It required that protected
health information remain private and protected, and that only
authorized users were permitted to access PHI. It also allotted for
covered entities to develop new technologies to keep PHI intact.
These covered entities consist of health care professional,
facilities and any business associates who use or transmit health
care information electronically. It also holds them accountable to
maintaining security and privacy of PHI or face consequences if
found not in compliance.
What stakeholders are impacted by
this policy (e.g., health care
consumers, medical staff, etc.)?
Major stakeholders impacted by HIPAA include health care
consumers (patients), covered health care providers, covered
health care employees, health insurance carriers, and electronic
medical record (EMR) development companies (Edemekong &
Haydel, 2019). Each identified stakeholder is uniquely impacted.
For instance, patients or health care consumers are impacted as
HIPAA directly relates to personal patient data. According to
Edemekong & Haydel (2019), a provision of HIPAA is that
patients must provide written consent to release their private
information. Another example is found in how health care
employee stakeholder is impacted. For instance, health care
employees must parktake in HIPAA related training and uphold
its security, privacy and safeguarding standards in daily work
(Edemekong & Haydel, 2019). Similar standards hold true to
health insurance entities and EMR development companies. An
EMR program must adhere to HIPAA standards in terms of
safeguarding and protecting patient data.
In your opinion:
In my opinion, I tend to believe the HIPAA policy has been
effective, especially to the patients. This is because, through the
policy, it has ensured that patients health information’s are
protected from being accessed by unauthorized individuals,
thereby, ensuring there are data privacy and security for patients’
medical information. Another way in which the policy has been
effective is that business associates of HIPAA covered entities,
healthcare providers and healthcare clearinghouses have
implemented safeguards in which sensitive personal and health
information of the patients are protected (Cohen & Mello, 2018).
The HIPAA policy has adequately met the needs of the

population as intended since many healthcare organizations
currently use technologies that provide privacy and
confidentiality of a patient’s health information. The Electronic
Health Record is an example of a technology which was
developed as a result of the policy which ensures that
unauthorized individuals do not access patients health records;
thus, the security of their health records. The effectiveness of
HIPPA policy has been verified since many health care
organizations have a HIPAA verification tool in which patients
are required to fill to ascertain that the facility that they have
visited is HIPAA compliant. The effectiveness of the policy has
also been verified by HIPAA engaging in verifying whether the
many healthcare organizations in the country utilize the federally
mandated best practices within the HIPAA compliance program
which safeguard and protect health information.
Discuss the health and societal
issues that had an impact on the
development of the health care
policy.
Prior to the enactment of HIPAA, there were limited to no
standards to protect patient information, protect patient privacy,
protect health insurance coverage, or offer support toward the
transmission of data via electronic means. Thus, patient
information was stored in paper format, easy misplaced, and
openly accessible. Individuals experiencing job changes or loss
experienced gaps in health care coverage. According to Bowers
(2001), a foundation of which HIPAA is built upon is the
protection of health insurance coverage for individuals who lose
their jobs or who are in the midst of changing jobs. HIPAA
changed this. HIPAA further added directives to guide safeguard
measures for electronic transmission of patient data.
